Ok, so it’s actually two questions, but they go hand in hand. From Paul Hein at Strike the Root:
1. If governmental action is NOT in accord with the Constitution, is the government legitimate?
2. If a government is not legitimate, can it command your obedience?
My answers? ”No” and “only by force.”
I have been toying with the Idea that each illegitimate act of government should be treated as illegitimate by itself, rather then to treat the whole of the government as illegitimate upon the first infraction.
Lets face it the history of government has demonstrated that infractions are rather common, and we cant afford to replace the government every time they happen because one particular group of politicians don't know their place.
So perhaps a compromises would have us treat each infraction on an individual basis, and keep a list of them for future evaluations. Recognizing the imperfection of government and their very human leaders as we attempt to settle on a reasonable balance. While possibly plugging the holes.
The only legitimate government works within the original intent and framework of the constitution. Any other government is not just illegitimate, but an overthrow of this original government. It is technically a bloodless coup. This, though, does not legitimize said government, but only helps define parameters. (this is not the kook version, but only a simplified example.) Our present b.....dized form of government works under the guise of emergencies to keep the people subdued, this is the only time from my reading that any part of the constitution can be circumvented.(in their mind) Truth be told, it can be transgressed at any time, it is just a domestic usurpation of authority, which gives no authority. I will ignore any such authority. It can demand, it can command you to obey. I can command you to obey me as well. The issue then merely becomes: Are you willing to resist, and what price are you willing to pay?
