This makes it valid legal defense. You can't throw it out because you think it is racist because the only way you can alter the constitution is by the amendment process. I think if they don't like it then they should move to undo it through the amendment process (not by a moral condemnation of it) but until then it is a part of the constitution so it is legal for it to be used in a court of law.
