The new session of the Tennessee General Assembly will begin in January 2011.  In preparation for the upcoming session, the Tennessee Tenth Amendment Center is rolling out its Adopt A Legislator Program for the 2011 session.  With the drastic change in the House’s balance of power, we hope there is a better chance of getting Tenth Amendment legislation passed through the committee structure and onto the House floor this year.

To prepare for the upcoming session, we need to get Tenth Amendment Center model legislation in front of our legislators.  All of our legislation is listed below.  Click on the name of each piece of legislation to download a PDF that you can either e-mail or print and give to your legislators.  Additionally we are in the process of preparing some model legislation to deal with the airport body scanners as well, and hope to have that posted soon.

The important thing is for each person to adopt two or more legislators, either your own senator and representative or others, and help us get this legislation into their hands.  Encourage these legislators to introduce, co-sponsor, and vote for these pieces of legislation that are so critical to asserting Tennessee’s Tenth Amendment powers.  Most importantly, when you have contacted these legislators, go to our Contact Form, and let us know which legislators you have contacted, so we can track which legislators have and have not been contacted.

Throughout the legislative session, we will also be posting Action Items for you to contact various legislators, including your adopted legislators.  Building solid relationships with our Tennessee legislators is going to be key in ensuring that our legislation is introduced and passed.  Please remember to be courteous and respectful in communicating with the legislators.

Tenth Amendment Center Model Legislation

Constitutional Tender Act

The General Assembly finds and declares that sound, constitutionally based money is essential to the livelihood of the people of this state and to the stability and growth of the economy of this state and region and vitally affects the public interest. The General Assembly further finds that Article I, Section 10 of the United States Constitution provides that no state shall make any thing but gold and silver coin a tender in payment of debts.

Controlled Substances Nullification Act

An Act to render null and void certain unconstitutional laws enacted by the Congress of the United States, prohibiting the sale, production, possession and consumption of certain products and substances under threat of penalty.

Defend the Guard Act

For the purpose of requiring the Governor to withhold or withdraw approval of the transfer of this State’s National Guard to federal control in the absence of an explicit authorization adopted by the Federal Government in pursuance of the powers delegated to the Federal Government in Article I, Section 8, Clause 15 of the U.S. Constitution.

Environmental Preservation Act

Any federal law, rule, order, or other act by the federal government violating the provisions of this act is hereby declared to be invalid in this state, is not recognized by and is specifically rejected by this state, and is considered as null and void and of no effect in this state.

Federal Health Care Nullification Act

An Act to render null and void certain unconstitutional laws enacted by the Congress of the United States, taking control over the health insurance industry and mandating that individuals purchase health insurance under threat of penalty.

Freedom from Registration Act

To make findings of the General Assembly in regard to a person’s right to keep and bear arms, to provide that no federal official or agent may require registration of purchasers of firearms or ammunition within the boundaries of Tennessee, and to provide penalties for violation of this act which is a felony.

Hemp Freedom Act

To authorize the production of industrial hemp; to amend the Tennessee Code Annotated, relating to the definition of noxious weed seeds; and to nullify certain acts of the Federal Government of the United States purporting to be laws and regulations resulting in the prohibition of industrial hemp farming in the state of Tennessee.

Intrastate Commerce Act

Provides that all goods manufactured or made in Tennessee and all services performed in Tennessee, when such goods or services are held, maintained, or retained in Tennessee, shall not be subject to the authority of the Congress of the United States under its constitutional power to regulate commerce.

Uniform Enumerated Powers Act

A Bill to require the federal government to specify the source of authority under the United States Constitution for the enactment of laws, and for other purposes.  If such is not specified within any federal legislation, it will be considered null and void within the boundaries of Tennessee.
