Today’s email in box brought two REAL ID messages. Both of them follow below.  The first, from a FL TAC reader named Kathy expresses the frustration and sense of powerlessness we law abiding citizens face here in Florida. Please help by writing, calling and emailing your state senator and representative and tell them you strongly favor the repeal of Florida REAL ID. The second, from our good friend Paul Henry at Floridians Against REAL ID is the antidote for Kathy’s and all our problems surrounding the Florida legislature’s REAL ID act.  This ill advised legislation will not keep one person from creating mayhem against us. It does however, place our information in cyberspace for misuse and abuse. This has already happened on more than one occasion.  So much for our Fourth Amendment rights.

“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”-Fourth amendment to the US Constitution and also found in the Florida Constitution in Section 12:


SECTION 12.  Searches and seizures.–The right of the people to be secure in their persons, houses, papers and effects against unreasonable searches and seizures, and against the unreasonable interception of private communications by any means, shall not be violated. No warrant shall be issued except upon probable cause, supported by affidavit, particularly describing the place or places to be searched, the person or persons, thing or things to be seized, the communication to be intercepted, and the nature of evidence to be obtained. This right shall be construed in conformity with the 4th Amendment to the United States Constitution, as interpreted by the United States Supreme Court. Articles or information obtained in violation of this right shall not be admissible in evidence if such articles or information would be inadmissible under decisions of the United States Supreme Court construing the 4th Amendment to the United States Constitution.”

The Florida Tenth Amendment Center wholeheartedly supports Floridians Against REAL ID  efforts to have REAL ID repealed in Florida.  None of us in the Liberty movement hold grudges or make judgements against those who authored and shepherded this bill to passage in 2008. Everyone makes a mistake. The return to Liberty is a process. We did not lose it overnight and we will not regain it overnight.  We urge and welcome those who helped craft and pass this legislation  to assist in its repeal. That repeal will stand as a monument to their love of freedom and their committment to Liberty.

Kathy’s Email: I’m having a horrible experience with these new requirements by the DMV in Florida. I got an extension of 60 days to renew my driver’s license and with only 2 weeks left, I haven’t been able to come up with the document that I need. I don’t have a passport and my maiden name on my birth certificate doesn’t match my married name on my social security card, so they want to see my marriage license. But I cannot find my marriage license and since I was married in Jamaica in 1983, there is no record of it here in Miami. After many attempts to get it from Jamaica, I’ve gotten no help from them at all. I was born in Ohio, lived in Miami since 1959 and have had a Florida driver’s license since 1970 in both my maiden and married names. Am I supposed to be denied my driving privileges now due to the Real ID act?
