This republic was founded as a compact by the several states to form a national government, but that notion has been forgotten for some time now as Leviathan has usurped power from the states at every turn, having shown a blatant disregard for the 10th Amendment.

But times they are a changing and we the people are waking up and realizing that we need to stand up and take back what is rightfully ours. To this end Professor Randy Barnett has proposed an amendment to the Constitution, the Repeal Amendment, whereby the states would be able to repeal any federal law if 2/3 of the states see fit. Virginia House Speaker Bill Howell, who co-wrote a WSJ op-ed on the amendment with Prof Barnett, intends to have the Virginia General Assembly apply for an Article V Convention with the hopes of getting 33 other states to do the same and ultimately pass the amendment.

Well, Leviathan must be sensing that the heat is on because Sen. Roger Wicker R-MS is about to propose the 10th Amendment Regulatory Reform Act in the vein of HR 4946, which was proposed by Rep. Tom Cole R-OK back in March. This, however, is just a smokescreen because both pieces of legislation only go as far as allowing the states to protest proposed regulations by federal agencies. Nowhere does it allow the states a say in unconstitutional laws passed by Congress. That dog just won’t hunt.

Leviathan must be put on notice that we will not accept watered-down legislation meant to placate us; we want our seat at the table and want no less than an ironclad commitment, such as the Repeal Amendment, to give us our say. It is quite simple, they can do it by a 2/3 vote in both Houses or the states can begin the process and force their hand. Either way, the states will again have a check against the currently unfettered federal power.
