PHOENIX (March 27, 2012) – In a surprising move, the Arizona House Rules Committee killed a bill that would help protect citizens of the Grand Canyon State from federal kidnapping.
Only immediate action by Arizona residents can resurrect this crucial piece of legislation.
The committee voted 5-4 to block passage of SB1182, which would “prohibit any agency of the state from providing material support for or from participating in any way with the implementation of sections 1021 and 1022 of the National Defense Authorization Act of 2012, Public Law 112‑81, against any citizen of the United States.”
The legislation breezed through the Senate earlier this month by a 21-9 vote and was approved 6-3 by the House Military Affairs and Public Safety Committee on March 14. SB1182 appeared on track for consideration by the full House when the Rules Committee derailed it.
Sources say hope remains. A committee member may change his/her vote and ask for another hearing on the bill. Rep. Bob Robson and Rep. Steve Court apparently represent the swing votes.
“It’s imperative that these representatives of the people of Arizona understand just how important this bill is,” Tenth Amendment Center communications director Mike Maharrey said. “They swore an oath to uphold and defend the constitutions of the United States and Arizona. One of the most fundamental rights it that of due process. They have a duty to interpose on behalf of the people they represent when their basic rights are threatened. The detention provisions in the NDAA are vague, overbroad and open to interpretation, and we all know the federal government is not going to willingly pass up power, even illegitimate power. The states must stand in the gap.”
