According to the West Chester Patch, two Tenth Amendment legislative items are on the House calendar in Pennsylvania this week.

First, the House State Government Committee will take up SB10, “A Joint Resolution proposing an amendment to the Constitution of the Commonwealth of Pennsylvania, providing for health care services“, in a hearing beginning at 9am tomorrow. This legislation proposes an amendment to our state Constitution which prohibits:

  • laws requiring an individual to purchase health insurance;
  • penalties for direct payment for health care services; and
  • penalties, taxes, assessments or fees for failure to purchase health insurance.

The Tenth Amendment Center has previously covered SB10 here and here. This proposed amendment would protect Pennsylvanians’ rights to quality health care and individual choice from unconstitutional encroachment by the Patient Protection And Affordable Care Act.

Also HR16, “A Resolution memorializing Congress to address concerns raised by security screening methods employed by the Transportation Security Administration“, comes up for second consideration. This resolution calls on Congress to place greater restrictions on the use of enhanced pat-downs and screening devices; and to limit the use of advanced imaging devices and enhanced pat-downs to situations where the subject is under arrest, a search warrant has been issued, or probable cause exists.

This proposed resolution would serve notice to Congress and the Transportation Security Administration (TSA) that Pennsylvanians expect the groundless searches and intrusions on our persons and possessions by the TSA to come to an end; that we expect to be able to travel in safety and with dignity.

Finally, we have received a press release from Constable Ed Quiggle of a signing event this Saturday, May 26. Constable Quiggle, from the City of Sunbury’s 9th Ward, will be signing a resolution in opposition to the military detention and rendition of US citizens and legal residents under provisions of the NDAA of 2012.
