On November 6th, after Colorado’s election numbers came in and solidified that Colorado was the first state to legalize marijuana for recreational use, Colorado Governor John Hickenlooper made this statement…
“The voters have spoken and we have to respect their will. This will be a complicated process, but we intend to follow through. That said, federal law still says marijuana is an illegal drug so don’t break out the Cheetos or gold fish too quickly.”
Hey Governor, here’s some news… Federal Law only trumps state laws in cases where the power has been delegated to the Feds in the Constitution.
This would include running the post office, delivering the mail, and other limited powers spelled out in the Constitution. For the federal government to distort the meaning of the Supremacy Clause to make it seem like they have the power to do anything they like is the definition of a tyranny. Right in the wording of the Supremacy Clause are the words “in pursuance thereof” which simply states that the federal government has the supreme power over the limited powers delegated to it…
Nowhere in the Constitution does it authorize a Food and Drug Administration, or an Environmental Protection Agency, or mandatory health care for that matter. These are all unconstitutional programs. Sure there may be a federal law on the table saying marijuana is illegal, but the federal government never had the authority to create such a law in the first place.
Read the Principles of 98…this IS nullification and it was given to us by Thomas Jefferson and James Madison in the late 1700’s.
Also, Governor, the people of your state exercised their freedom as citizens last night. It took a lot for this amendment to get passed, it’s an extremely arduous process. Just because you disagree with your employers (or the people of your state), do you really think it’s wise to insult them like little kids with threats and Cheetos jokes?
This is political suicide. Amendment 64 passed with a majority vote, and the first thing good ol’ “Hick” does, instead of standing up for the citizens of his state, he insults the majority who voted the amendment in with stoner jokes…classy move Governor.
