The fact the Governor Perdue has made a decision to work with the Federal government to implement a federal-state healthcare exchange in North Carolina should come as no surprise. She is a BIG government progressive politician and she is only doing what BIG government progressive politicians always do, bow down to the Federal government. The real problem is she is going against the wishes of the citizens of North Carolina, which rejected democrats both in the State House and Senate and for the governorship of North Carolina. She is attempting to tie the hands of the new State Legislature and the incoming governor-elect Pat McCrory, but was it nessary.

It has been reported in a Charlotte Observer news article that Governor Perdue said she preferred a state operated exchange, but chose the intermediate course so that governor-elect Pat McCrory and the legislature can make a future choice to go to a fully state run or federally run exchange. But this was not her decision to make she is and lame-duck governor making a choice for the citizens of North Carolina, a decision that does not need be made until after the first of the year.

In a statement Perdue said, “It will be an important choice and one the incoming administration is very aware of.”

Senate leader Phil Berger in a statement November 15, stating that Perdue was making a decision to an important issue that it should have been left to McCrory. “Let’s set the record straight — it is not necessary or appropriate for Governor Perdue to prematurely declare her intent to establish a state-federal partnership exchange. The initial deadline for the state to make this declaration is February 15, 2013 — three months from today. The voter’s elected and new legislature and the governor last week and policy decisions of this magnitude should be left to them.”

Senator Berger in his statement use the term state-federal partnership, make no mistake about it, it will not be a state-federal partnership it will always be a federal-state partnership, the state may have the responsibility to run the exchange but the Federal government will set the guidelines and have the final authority.

Senator Berger was definitely on the right track concerning Perdue’s decision but then he went on to state that he did not object to the states applying for Federal grants (in the amount of $73.5 million) to pay the state’s cost “as long as it does not frivolously spend the tax dollars until the new leaders determine the next steps.”

In a statement that leaves open the possibility of Obamacare in North Carolina governor-elect Pat McCrory stated, “Governor Perdue’s decision leaves flexibility for North Carolina and in the future when it comes to the delivery of Health Care. I will be discussing this with more governors today, and will continue those discussions in the coming weeks to ensure the best results for North Carolina.” This only further worries those who have had their doubts about his conservative principles since he did everything in his power to avoid stating his position on Obamacare during the campaign.

The question now becomes, is this a case of meet the new boss same as the old boss? The voters of North Carolina further strengthened the Republican majorities in both the State House and Senate and elected a Republican to the governorship. Did the voters get what they thought they were getting or just a watered down version of the rejected Democrats and their policies?

In McCrory’s statement that he is discussing this with governors around the country, I hope he is noting that 20 states so far have rejected healthcare exchanges and several states have out right Nullified Obamacare for their states. Numerous states and governors have noted that irrespective of the Supreme Court’s decision the Federal government was not granted under the Constitution the power to oversee healthcare among the states nor the ability to force people to buy a product.

Thomas Jefferson said it best when he stated, the principle … “that the general government is the exclusive judge of the extent of the powers delegated to it, stop nothing short of despotism, since the discretion of those who administer the government, and not the Constitution, would be the measure of their powers; that the several states which formed that instrument, being sovereign and independent, have the unquestionable right to judge of its infractions; and that a positive defiance of those sovereignties, of all unauthorized acts done or attempted to be done under color of that instrument, is the rightful remedy.” (emphasis added)

Nullification is “the rightful remedy” for Obamacare!

Therefore, it is time for governor-elect McCrory and the legislative leadership to state unequivocally that it is their intention to return any grant monies from the Federal government for the establishment of healthcare exchanges. And, that they will introduce Health Care Freedom bills in the State Legislature to Nullify PPACA otherwise known as Obamacare at the opening of the North Carolina Legislature’s 2013 session.
