I feel the fundamental misunderstanding is that Congress can legislate away any of the Bill of Rights.
This requires an Amendment process. To try to legislate the Amendments constitutes TREASON!
The American people are so confused by school and the press that they actually believe these political hacks have it in their power to legislate the Constitution or the Amendments specifically. Forget executive orders! That is blatant treason and should result in immediate impeachment. Read Washingtons writings on the subject.
The Bill of Rights were never to be a basis of Law for the electorate. These are "the chains that bind them" spoken of by Jefferson. They are additional rules for the Federal Government, their employees and contractors. Admittedly the ink hadn't dried on the parchment when the political hacks were making noise about them being law for the electorate. This is the root of our problems. The 14th Amendment sealed that deal. But does these rules for the Federal Government really trump LAW?
The electorate or Citizens of The United States of America are supposed to live under Common Law. This could not be defined due to the social and political "realities" of the times, ie: women considered property legally, institutionalized slavery, foreign country's trying to get back into the American game, and religions that thought they could dictate every aspect of a free persons life, cradle to grave. We are not burdened by such beliefs now (at least not the majority).
What the Founders missed was not codifying LAW. (I feel Richard J Maybury has said it best with 17 words, "Do all you have agreed to do and do not encroach on other persons or their property".) Codify the Law, hold our "elected" "officials" to their Oath of Office (it is a legal and binding contract with the electorate), and stop with this nonsense that We The People are somehow beholden to the Bill of Rights as law for US. The Bill is for the Federal Government. Without the proper Amendment process they are committing Treason when they legislate such as the NDAA section 1031, the "Patriot Ac (?)t", Military Commissions Act, and such that are so obviously meant to destroy our civil liberties.
