Texas: Act Now to Nullify Federal Gun Laws

Texas House Bill 928, the Second Amendment Preservation Act, passed the House Federalism and Fiscal Responsibility Committee 3-1. This bill is on it’s way to the Calendar Committee to be put on a schedule to be voted by the full house.    Your action is needed now to help this bill get passed by the Texas House!

The bill would require all agencies of the state – and local governments – to refuse to enforce or assist in the enforcement of a vast majority of federal gun laws, including those already on the books.  As Judge Andrew Napolitano has said recently, such widespread noncompliance can make a federal law “nearly impossible to enforce” (video here)

Surprisingly, an amendment was added in committee that actually made the bill stronger.  It now includes a penalty for any local government which refuses to follow the proposed law.  This includes a loss of state grant funding and the ability of individual Texans to file a complaint with the Attorney General against the local government violating their rights.

The bill must first go through the Calendars committee before it will be voted on by the State House.  The Tenth Amendment Center requests your immediate help to move HB928 forward.

North Carolina House Bill 518, the Firearms Freedom Act, is currently in the Judiciary Committee. This bill states that any firearm in the borders of North Carolina is not subject to any Federal Regulation, Law, Order, or Taxation.

As we see many firearm manufacturers threaten to leave states that are making oppressive gun legislation, bills such as H518 are a great step forward.  It’s a welcome mat to come to North Carolina.

Passing H518 promotes job growth and protects firearms within the state of North Carolina. Your help is needed to move this bill forward out of committee.

Michigan Action Alert: Help Nullify Federal Gun Control

Michigan House Bill 4457 is a strong bill in support of the right to keep and bear arms.  It needs your help to move forward!

HB4457 would nullify a large number of unconstitutional federal gun laws. It reads, in part:  “A public servant or dealer that sells a firearm in this state shall not enforce or attempt to enforce any act, law, statute, rule, or regulation of the United States government relating to a personal firearm, firearm accessory, or ammunition that is owned or manufactured exclusively within the borders of this state.”

The short version?  If you own it and keep it in Michigan, federal “laws” don’t apply and the state of Michigan will not enforce them.  As Judge Andrew Napolitano has said recently, such widespread noncompliance can make a federal law “nearly impossible to enforce” (video here)

New York Action Alert: Help Nullify Warrantless Drone Spying

New York Assembly Bill 6244, Protection Against Unwarranted Surveillance, is a bill to nullify warrantless drone spying.  It is currently in the Committee on Codes and needs your help to move forward.

A6244 states, “no  person  or  entity  acting under color of the authority of any state, county, municipal or local governmental entity or  authority,  or acting  on  behalf  of any such entity or authority, shall use, operate, engage or employ an unmanned aerial vehicle as defined in  this  section to  gather  evidence or other information related to a criminal investigation, criminal case, or conduct in violation of regulation except when authorized under a warrant issued by a court of record or  justified  by  lawful exception to the warrant requirement.”

Illinois Action Alert: Help Nullify Drone Spying

Illinois SB1587, Freedom from Drone Surveillance Act, passed the State Senate Committee on Criminal Law with a 7-2 vote.  It will now have a hearing and final vote in the full State Senate on April 10th.  Your help is needed right now to get it passed!

Although the bill provides for some exceptions, if passed into law a vast majority of drone use would be banned.  Law enforcement would be banned in almost every situation from using a drone without warrant.  This is a BIG step forward for the privacy in the State of Illinois.  Please act now to support SB1587.

Louisiana Action Alert: Help Pass the Firearms Freedom Act

House Bill 45, the Louisiana Manufactured Firearms and Ammunition Act, is currently in the Committee on Administration of Criminal Justice. It would nullify federal regulations on any firearm made and retained within Louisiana.

This bill states, in part: “all regulation of intrastate commerce is expressly reserved to the authority of the states. Manufacturing and sales of certain firearms, firearm accessories,and ammunition which are manufactured solely within the borders of the state of Louisiana and deemed to be matters of intrastate commerce and are not subject to federal regulation.”

HB45 not only protects the firearms within the state of Louisiana, but will also encourage firearm manufacturers to move to Louisiana from oppressive state laws elsewhere.

Passing HB45 will also promote job growth and protect firearms within the state of Louisiana. Your help is needed to move this bill forward out of committee.

Colorado: Help Nullify the Unconstitutional Federal Ban on Hemp

Colorado is considering a bill to legalize Industrial Hemp within its borders. The federal government has no constitutional authority to ban the production of this industrial plant.   Senate bill 13-241 would nullify that unconstitutional federal control, and return it where it belongs, to the state of Colorado.

The United States is currently the world’s #1 importer of hemp, which is used in food products, clothing, oil and much more.  The top exporters are China and Canada.  At this time of economic difficulty, 13-241 would not only expand freedom and support the Constitution, it would also be a great jobs bill.

Senate Bill 13-241 is currently in the Senate Committee on Agriculture, Natural Resources, and Energy. Your help is needed to move this bill forward and nullify federal control.

Missouri: Help Nullify NDAA Indefinite Detention

Missouri House Bill 57 (HB57), the Liberty Preservation Act, prohibits any state agent or national guard from aiding any agency or the armed forces in pursuance of NDAA “indefinite detention”

HB57 has passed the Committee on Downsizing State Government. And it has to go to the Rules Committee before it will be sent to the House for a full vote.

Your help is needed right now to nullify the NDAA in the State of Missouri! Not much time is left in the legislative session, and this bill needs to move forward soon. The Rules Committee is a logistical committee setting the environment on how this bill will be voted on by the House. Delays can affect the outcome of this bill.

Texas Action Alert: Support the Health Care Freedom Act

Texas House Joint Resolution 48, is legislation that proposes a state constitutional amendment to deal directly with Obamacare mandates.  It’s up for a hearing this week and your support is needed!

It reads, in part: “(a) Each individual in this state has the right to choose or decline to choose to purchase health insurance coverage without penalty or sanction or threat of penalty or sanction.

(b) A state agency, public official, employee, or political subdivision of this state may not act to impose, collect, enforce, or effectuate a penalty or sanction intended to punish or discourage the exercise of the right described by Subsection (a) of this section.”

This would, by the Constitution, ban state participation in Obamacare exchanges and anything else which leads to a penalty under the federal act.  Doing so will ensure that this important decision isn’t just left to the whims of one politician future.  And refusing to comply on exchanges and medicaid expansion has been shown by CATO institute researchers to be something that will likely bring Obamacare to its knees.  (read more here)

Tennessee: Act Now to Help Nullify Gun Control

While the State legislature has been fairly adamant in rejecting bills to nullify federal gun control laws, Senate Bill 795 takes a different approach to the same end goal – protecting your right to keep and bear arms.  And it does it in a way which eliminates the so-called problems with other bills which have been rejected, such as SB250.  Any committee member who voted NO on SB250, but claimed to be in support of the 2nd Amendment, will be outed as a fraud if they also reject SB795.  (more details below)

This is a VERY important bill.  A hearing and potential vote will happen this week and your calls are needed in support right now.

Senate Bill 795 reads, in part: “no public funds, personnel or property of this state or any political subdivision of this state shall be allocated to the implementation, regulation or enforcement of any federal law, executive order, rule or regulation, or any treaty signed by the United States, that becomes effective on or after January 1, 2013, that adversely affects a United States citizen’s ability to lawfully possess or carry firearms in this state.”
