Recently, Author and Fox News Senior Judicial Analyst Judge Andrew Napolitano took the podium as the keynote speaker at the Texas Conservative Coalition Tenth Amendment Town Hall Meeting.

In the following six minute clip from his speech, Judge Napolitano explains how the 10th amendment was designed to limit the size of the federal government, how US Senators were not to go to Washington to expand the power of the federal government and that powers not authorized by the states are reserved to the people of the states. The Judge also points out that the intention of the 17th amendment was to assault the 10th – by attacking the very basic values of the constitution. He then goes on to lay out the “federal table” and the rank of power as being “the people, the states as states, and then the country as a whole.”

“The most unique of the 10 amendments is the 10th… It is a truism. The powers not delegated in this constitution, to the new government, are retained by the states and the people respectively. That was there to assure that what was written down in the constitution, those little pieces of sovereignty that each state gave away, could not be expanded upon by the feds.”
