A bill introduced in the Louisiana State House of Representatives would expressly ban an important provision of Obamacare.

House Bill 335 (HB335) explicitly prohibits the creation of health care exchanges under the unpopular Obamacare law. While Louisiana has so far opted out of creating a state exchange, this legislation would codify the current policy into law. in addition, HB335 would prohibit state agencies or political subdivisions from participating in or purchasing insurance from an exchange created and run by a non-profit. Some have floated the idea of having the feds to fund nonprofits to create exchanges in states refusing to set them up. This provisions would make that impractical in Louisiana.

The bill would also prohibit state agencies, officers, and employees from conducting or participating in involuntary home visits under the maternal, infant, and early childhood in-home visitation program under the act.

Other sections of HB335 make a strong statement, but would have little practical effect. The legislation would prohibit enforcement of any Obamacare provision that exceeds the authority of the Constitution. But that becomes problematic because it leaves that determination up in the air.

States such as South Carolina and Georgia are taking comprehensive action this year to combat the ill-effects of Obama’s federal health care scheme that more closely resemble the Tenth Amendment Center four-step plan.

HB335 is definitely a step in the right direction. Banning exchanges represents a solid first step and the additional language could encourage more action in the future.

The bill was filed on Feb. 24 and referred to the Committee on Health and Welfare.
