The following is a letter from California resident and activist Brian Gonzalez to his Assembly representative on SB443. This bill takes on Asset Forfeiture in the state, and would close a huge federal loophole that allows local police in California circumvent state-level asset forfeiture restrictions by “passing off” cases to federal agents and still getting up to 80% of the proceeds. Dear Assemblywoman Grove,

Today we live in an America where the Constitution has become irrelevant to the common person. We live in an America when Federal law supersedes the Constitution instead of strengthening it. In America we’ve become used the idea that the Constitution only applies to some and not all. We’ve become fascinated with us and them never realizing that it is we that loses when the Constitution becomes a dream.

No person shall “be deprived of life, liberty, or property, without due process of law” 5th Amendment of the Constitution. This right, like so many others, has been afforded to me and the 320,000,000 other Americans. This right has been stolen by Civil Asset Forfeiture (CAF) laws A.K.A. “Police For Profit”. Depriving citizens of their right to private property and due process has become the status quo. No longer are we or our property presumed innocent. It is the intention of CAF laws that we are presumed guilty until proven innocent. This is fundamentally backwards.

Assemblywoman Grove, you have an opportunity to right so many wrongs this law has incurred on Californians. You can help set the example to the other states of the Union by guaranteeing our right to due process and having our guilt proven. You voted no on SB-443 last year but you have an opportunity to instill in California the right to due process and the right to innocent until proven guilty for both the citizen and their properties. Prove that the rights afforded to us by the Constitution isn’t a dream for some but a reality for all.

Refuse the idea to nothing because you can’t do everything. Start with something and go from there.
