<p>Introduced in the Virginia House of Delegates is House Bill 1160 (<a href="http://lis.virginia.gov/cgi-bin/legp604.exe?121+ful+HB1160">HB1160</a>) which &#8220;Prevents any agency, political subdivision, employee, or member of the military of Virginia from assisting an agency or the armed forces of the United States in the investigation, prosecution, or detainment of a United States citizen in violation of the Constitution of Virginia.&#8221;</p>
<p>The bill is sponsored by Delegate Bob Marshall and was introduced on 01-16-12. It has been assigned to the House Courts of Justice Sub-Committee: #2 Civil. <a href="http://lis.virginia.gov/cgi-bin/legp604.exe?121+sub+H08002">Visit this link</a> for information on this Subcommittee.</p>
<p>The bill reads as follows:</p>
<blockquote><p>Be it enacted by the General Assembly of Virginia:</p>
<p>1. § 1. Notwithstanding any contrary provision of law, no agency of the Commonwealth as defined in § 8.01-385 of the Code of Virginia, political subdivision of the Commonwealth as defined in § 8.01-385 of the Code of Virginia, employee of either acting in his official capacity, or any member of the Virginia National Guard or Virginia Defense Force, when such a member is serving in the Virginia National Guard or the Virginia Defense Force on official state duty, may engage in any activity that aids an agency of or the armed forces of the United States in the execution of 50 U.S.C. 1541 as provided by the National Defense Authorization Act for Fiscal Year 2012 (P.L. 112-18, § 1021) in the investigation, prosecution, or detainment of any citizen of the United States in violation of Article I, Section 8 or 11 of the Constitution of Virginia.</p></blockquote>
<p>Virginia is now the first state in the nation to introduce and consider a version of the Liberty Preservation Act (<a href="http://tenthamendmentcenter.com/legislation/liberty-preservation-act/">click here for model legislation for your state</a>) in response to unconstitutional kidnapping provisions in the National Defense Authorization Act (NDAA) of 2012. 			<content:encoded><![CDATA[<p>Soon, the New Hampshire General Assembly will vote on a resolution on the use &#8211; and misuse &#8211; of the State&#8217;s National Guard troops. <a href="http://www.gencourt.state.nh.us/bill_status/bill_status.aspx?lsr=2336&amp;sy=2012&amp;sortoption=&amp;txtsessionyear=2012&amp;txtbillnumber=hjr21&amp;q=1">HJR21</a> &#8220;A RESOLUTION informing the United States Congress that it is the desire of the general court of New Hampshire that the New Hampshire national guard shall not serve outside the borders of New Hampshire absent a declaration of war.&#8221;</p>
<p>Good intentions here, for sure. Article I, Section 8, Clauses 15 and 16 control the organizing, arming, and disciplining of these units as well as when they can be called for for federal duty.</p>
<p>In Article 1, Section 8 Congress Shall have the power&#8230;</p>
<p>Clause 15 &#8211; To provide for calling forth the Militia to execute the Laws of the Union, suppress Insurrections and repel Invasions; <span id="more-9867"></span></p>
<p>Clause 16 &#8211; To provide for organizing, arming, and disciplining, the Militia, and for governing such Part of them as may be employed in the Service of the United States, reserving to the States respectively, the Appointment of the Officers, and the Authority of training the Militia according to the discipline prescribed by Congress;</p>
<p>In 1903, under the Congressional power to &#8220;organize&#8221; the Militia, Congress named those units Constitutionally-authorized to be called for federal duty under Clause 15, the &#8220;National Guard.&#8221; But, even with this new, and misdirected name, they still remain under control of the individual states except in those instances delegated to the federal government in Clause 15.</p>
<p>So, while HJR21 gets it close as a Constitutional principle, Guard troops would stay in the state even with a Declaration of War from Congress &#8211; unless the need was a foreign army threatening to enter the borders of the United States. But, since a Declaration hasn&#8217;t happened &#8211; as it should &#8211; since World War II, the practical effect would be the same. New Hampshire&#8217;s national guard troops (and every other state for that matter) should be recalled to their states &#8211; now.</p>
<p>A better option than petitioning and begging Congress to do what&#8217;s right &#8211; which they almost never do &#8211; would be to pass the Tenth Amendment Center&#8217;s Defend the Guard Act, which puts these ideas into law. It is an act &#8220;FOR the purpose of requiring the Governor to withhold or withdraw approval of the transfer of this State’s National Guard to federal control in the absence of an explicit authorization adopted by the Federal Government in pursuance of the powers delegated to the Federal Government in Article I, Section 8, Clause 15 of the U.S. Constitution.&#8221;</p>

New Hampshire</a> held in 2011:</p>
<blockquote><p>“We had a war about nullification. There was a war about nullification. The Civil War was about nullification, and I’m not sure I want to go there,” Santorum said. “If the state doesn’t like what the federal government is doing and they believe it’s unconstitutional, they can go to a federal court and they can take it up in a federal court. There is a process by which states can litigate.”</p></blockquote>
<p>Seems like Rick got these talking points right from Rachel Maddow, who&#8217;s been saying pretty much the same thing for over a year now.  For example, in her MSNBC segment last year called &#8220;<a href="http://www.msnbc.msn.com/id/26315908/vp/42562618#42562618">Confederates in the Attic</a>,&#8221; she said things like:</p>
<p><em>“The Confederacy and its politics are in fashion again.”  &#8220;Nullification led to anti-US militancy which led to cannons firing&#8230;&#8221;  &#8220;Nullification, which helped steer South Carolina into its militant anti-US stance is now enjoying a remarkable renaissance.&#8221;</em></p>
<p>Does that make you pause?  It should.</p>
<p>By the way, the Nullification Crisis in South Carolina did NOT &#8220;lead to the civil war&#8221; as so many idiots claim.  That happened almost 30 years prior.  Read about it <a href="http://tenthamendmentcenter.com/2010/01/08/resistance-is-not-futile-forgotten-lessons-from-the-nullification-crisis/">here</a>.  And, when the South seceded, it wasn&#8217;t an expansion of their nullification efforts.  South Carolina&#8217;s complaint &#8211; which led to their secession was because of the NORTH using nullification. In order to up our efforts to get 10th Amendment and Nullification bills introduced in state houses around the country, we need direct contact information for state legislators everywhere possible.  We&#8217;ve been putting together lists, but need help in a number of states.  What we need?  A spreadsheet &#8211; in google docs shared with info@tenthamendmentcenter.com or in MS Excel emailed to the same &#8211; with first name, last name and email address as columns.  Optional, but helpful, are party affiliation and phone number columns.  </p>

<p>3.  <strong>LEADERSHIP ROLES NEED TO BE FILLED ON STATE AND LOCAL LEVELS</strong><br />
Thomas Jefferson once wrote &#8211; &#8220;The several states composing the United States of America are not united on the principle of unlimited submission to their general government&#8230;&#8221; He and many leading founders advised us to look to state governments whenever 2 or more branches of the federal government were conspiring against the Constitution and your liberty.  <strong>We feel that time is now.</strong>  </p>
<p>The Tenth Amendment Center is currently expanding our local coordinator program, and are actively looking for people like you to take on a volunteer leadership role in states, counties and cities. This is a fantastic opportunity for someone who feels passion for freedom and wants to do something &#8211; other than the standard phone calls to congress and marches on D.C. &#8211; to make a difference.  You don&#8217;t have to be a professional, or an expert in any way &#8211; we&#8217;ll certainly provide you the tools to learn and grow. We can never share enough content, information, ideas, and perspectives &#8211; from a constitutional view.  If you&#8217;ve got something to say and you think you just might be pretty good at writing (whether you&#8217;ve published previously or not), send a few paragraphs or even a full article over to info@tenthamendmentcenter.com today.  Make sure to include your full name, your contact information, and a short statement about what the 10th Amendment means to you (1-3 sentences max).</p>
<p>5.  <strong>CONTACT YOUR OWN STATE LEGISLATORS AND URGE THEM TO INTRODUCE LEGISLATION&#8230;</strong><br />
&#8230;on any number of issues that might be important to you this coming session.  Ask them NOW, as many states require bills to be pre-filed quite early.  And the sooner they get contacted, the more likely it will be that they introduce some strong bills.  Use this link to find some legislation to send to your state legislators. <p>I constantly marvel that a free pass to sexually assault 1.8 million passengers daily doesn’t sufficiently occupy the Transportation Security Administration (TSA) to keep it from further lunacy.</p>
<p>But no. John “The Perv” Pistole, TSA’s “Administrator,” has decided its notorious blue gloves and brown-sorry, blue shirts aren’t uniform enough. So, “as we approach the 10th anniversary of 9/11,” the agency is issuing “a commemorative wristband for the entire TSA workforce to wear to join together in remembering 9/11…We are pleased to announce that wristbands with the inscription ‘TSA Remembers 2001–2011’ have been purchased” — ya know, I hate to play Scrooge here, but how much of our money did these bozos squander on this? — “and will be distributed to all employees.</p>
<p>The goo flows as thick and sickening as the delusion when it comes to what the bracelets symbolize: not only “the horrific events of that day,” but also “the critical role each of us plays in securing our nation. Although we are spread out across the country and the world, we are united in our mission to protect our fellow citizens and our nation’s transportation systems.” Who knew The Perv was a jokin’ kinda guy?</p>
<p>But at least he admits that morons comprise his staff. The wristbands supposedly “ensure that all of us remember why TSA was created.” Yeah, easy to forget that when you’re hunting non-existent terrorists and boxcutters all day. Recall that these are the geniuses who are going to read our minds for “malintent” by studying our behavior.</p>
<p>The memo closes with this repetitive treacle [warning: serious gagging ahead]: “These wristbands are a reminder not only of 9/11, but also of our shared sacrifice and collective commitment over the past ten years and a rededication to continue carrying out our counterterrorism mission. Thank you for your service and for taking care of one another.”</p>
<p>Time for a bourbon, no ice.</p>

<blockquote><p>Nullification of the Government of the United States of America, is not the ticket guy. The tenth amendment is more about the dualation of powers between the Federal and the State. Two Separate Sovereigns. The Senate Has Over Reached in some instance, so then you take the law to Court. If you don&#8217;t like the ruling of the Supreme Court, and the tons of appeals, at different levels both State and Federal (Ok not tons, but you get quite a few wacks at a bad piece of legislation, and an over reaching executive branch gets punished in the local courts by punishing the agent who abused their power.).</p>
<p> It&#8217;s not perfect, but it&#8217;s the best we got. So please kindly remove me from your e-mail lists, good luck with that whole over throwing the United States Government thing, and honestly&#8230; If you try to over through this Country, I will kill you myself as a traitor.
