Will DC be the next “State” to Nullify Federal Prohibition?

Oh the irony to think that the capital city of these united states will be nullifying their own law even while their agents are raiding dispensaries in the states.  The voters in the city of DC approved medical Marijuana in 1998, and finally all of the licensing is complete.  The dispensary by the name of Capital City Care will be the first to open on the 22nd of April within blocks of the White House, and with a clear view of the US Capital.  This will be a hugevictory for the forces of liberty, in the face of the growing police state.

After resisting the clear will of the American people for so long, DC could have to call it quits and accept the demise of the war on drugs (police state), as they join the 18 states that have already nullified the war on pot (as a legal drug) .  As I have always said, weed is much like the war on drugs.

Respectable opinion on weed seems to be that it is a “gateway drug”.  This is meant to give the impression that one puff of it will lead one through a gateway and down a path towards desperation, and dependence upon drugs for daily functioning.  Doing unspeakable things for the next hit of your current drug of choice.  Theft and violence will become the life of the addict or so says this paradigm.  In reality it is the war on drugs that is the gateway, it is a gateways towards tyranny, and authoritarianism.

It is ironically the so called “Constitutional” Conservative who are the biggest cheerleaders for this insane policy.  Even as they hold the correct position on so many policies that you should not pile additional laws on already illegal behavior (such as opposing gun control because murder is already illegal, or opposing hate crimes because the crimes they punish are already illegal.)  None the less they point towards the culture of crime that surrounds the drug trade (as surrounds all black markets regardless of the banned items for sale) and say “look drugs cause murders and robberies.”  Murder and theft are already illegal, so why is that an argument for prohibition? At a time when the Republican establishment is doing everything they can to alienate their constituents, and nullification measures are getting introduced around the country, it becomes more important than ever to step up and put our best foot forward when presenting our ideas to citizens desperately looking for a way to fight back against unjust federal power. Luckily, we have a shining example to follow in constitutional attorney KrisAnne Hall who gave an eloquent defense of ObamaCare nullification at the Florida Senate Select Committee on Monday, December 3rd.

Nothing to Worry About on Indefinite Detention? Guess Again

As mentioned in Friday’s feature article about the Feinstein-Lee Amendment by Tenth Amendment Center Legal Analyst Blake Filippi, it did absolutely nothing to rectify the loss of rights Americans faced from the indefinite detention provisions in the 2012 NDAA that we are working to nullify throughout the country. However, Senator Mike Lee disagrees about the effectiveness of the amendment and is using quite a bizarre rationale to defend it.

Lee released a press release on Friday in an attempt to clarify concerns with the Feinstein-Lee Amendment (http://www.lee.senate.gov/public/index.cfm/blog?ID=142f4fe6-3446-4d1a-b82b-df9503db1952). He stated that the 2012 NDAA did not actually authorize indefinite detention of American citizens. If this is the case, then why even pass the amendment in the first place? If the 2012 NDAA was so hunky dory and didn’t authorize indefinite detention of Americans, why propose an amendment to supposedly ensure that Americans wouldn’t be indefinitely detained (which was assumed by everyone to be a response to last year’s Act)?

Lee could not deny that last year’s NDAA would be the ‘Act of Congress’ needed to allow for indefinite detention of Americans. In his press release, he did not quote the provisions of the NDAA which are cause to alarm and we are working to nullify. He omitted this information while assuring us that since a sentence within the Act said that the government would never use the powers that they usurped against citizens that we are supposed to have no fears and feel protected thanks to his work. I’m not buying that the same gang that extra-judicially kills American citizens is going to have restraint in their interpretation of the 2012 NDAA, as Mike Lee apparently does.

Libertarian Republican Congressman Justin Amash agrees with the Tenth Amendment Center interpretation of Lee’s amendment saying, “The Feinstein amendment to the 2013 NDAA does NOT protect you from indefinite detention without charge or trial. In fact, it explicitly permits such detention so long as the detention is approved by an Act of Congress . . . such as the 2012 NDAA.”

This just goes to show you that even people who do a good job of talking the talk might not always walk the walk. Whether he’s simply misguided in an attempt to protect the Constitution for Americans or he’s working to push something he knows will have no effect to quell push-back against federal power grabs, tea party Senator Mike Lee is doing no favors for liberty working with Senator Feinstein and releasing misleading press releases about it. It’s become more obvious than ever that federal bureaucrats aren’t going to protect our liberty, and we’re going to have to work at the state and local level to circumvent the D.C.vers through nullification to protect our sacred rights.

Nullifying ObamaCare: An Alternative To The Supreme Court Ruling

Recently, the Supreme Court ruled that Obamacare was constitutional.

The Administration takes this as a green light to implement ObamaCare to its fullest extent possible. Because the election went in President Obama’s favor, the Senate and House have lost any desire to overturn the law. Without the overturn, it looks like the law making Obamacare a reality is going to stand forever.

Or is it?

In order to make Obamacare work properly, as it currently stands, there are two mainstays of Obamacare that must be carried out on the state level. Each state must implement an insurance exchange and they must drastically expand Medicare according to the law. These two items of ObamaCare will cost the states untold millions of dollars to implement.

When federal law goes bad, it is up to the states to protect their citizens. The legal theory is called nullification. Nullification is the idea that any given state has the right to invalidate federal laws that they consider unconstitutional. Somewhere along the line the Supreme Court got it wrong in their reasoning. Accordingly, it is like saying that since the government has a stake in GM it can create a law that says we can only buy GM cars. If we buy any other type of car we have to pay an extra tax on it. No Budget, No Freedom

There are rallying cries from the American revolutionary period which are still axiomatic in American Society. One was apparently coined by Jonathan Mayhew in a 1750 sermon, “Discourse Concerning Unlimited Submission and Non-resistance to the Higher Powers“. It is, “No taxation without representation.” Similarly, James Otis is often credited with the phrase, “Taxation without representation is tyranny.” It is claimed that Otis used this phrase in his legal argument against the Writs of Assistance.

These phrases are unquestionably correct in a free society, but what is it that makes them true? What are the characteristics of taxation without representation that make it tyrannical — and how do these principles apply to today’s American society?

Texas Moves To Nullify NDAA

House Bill 149 (LS: 83R) – Texas Liberty Preservation Act.

HB149 is a Bill introduced in the Texas Legislative Process on Nov. 12, 2012, by its author (Rep. Lyle Larson) and currently sits at stage 1 (filed). The design of the Bill is to nullify portions of the National Defense Authorization Act (NDAA) implemented by the federal law. Specifically, sections 1021 and 1022 are being made invalid and illegal in the State of Texas. Section (1) (b) (1) of the Bill lays out the constitutional groundwork of the findings that prompted the bill in the first place. It notes the limitations of the federal government under the 10th Amendment. It read:

(1) The Tenth Amendment to the United States Constitution authorizes the United States federal government to exercise only those powers specifically delegated to it under Article I, Section 8, United States Constitution;

Many people think that whatever the federal government creates as law it is the “supreme law of the land” but that is not true. Often the federal government creates laws that are thrown out because they go beyond the powers delegated to the government in the Constitution. Section 1.1. Humanity stands at a defining moment in history. We are confronted with a perpetuation of disparities between and within nations, a worsening of poverty, hunger, ill health and illiteracy, and the continuing deterioration of the ecosystems on which we depend for our well-being. However, integration of environment and development concerns and greater attention to them will lead to the fulfilment of basic needs, improved living standards for all, better protected and managed ecosystems and a safer, more prosperous future. No nation can achieve this on its own; but together we can – in a global partnership for sustainable development.

Section 1.3. Agenda 21 addresses the pressing problems of today and also aims at preparing the world for the challenges of the next century. It reflects a global consensus and political commitment at the highest level on development and environment cooperation. Its successful implementation is first and foremost the responsibility of Governments. National strategies, plans, policies and processes are crucial in achieving this. International cooperation should support and supplement such national efforts. In this context, the United Nations system has a key role to play. Other international, regional and subregional organizations are also called upon to contribute to this effort. The broadest public participation and the active involvement of the non-governmental organizations and other groups should also be encouraged.

Police State Clashes with Protesters in Chicago

With the recent outburst of Police-State action in Chicago, while we’d hoped it wouldn’t come to this – we can’t say we didn’t know it was coming. With images coming not out of Iran or Egypt, but out of some of the Tenther communities own back yard, we’re witnessing a literal army of state and federal funded police, in riot gear bloodying faces, shoving people – and according to some reports – even running people over. So it’s understandable that the Liberty community is a little apprehensive that what we’re witnessing isn’t yet another exception to the rule – but a sign of things to come for every-day Americans in the near future.

And regardless of where Tenthers choose to stand on the Occupy movement, the escalating action on the part of the local, State and Federal Government is certainly worthy of condemnation in regards to obvious first-amendment Constitutional violations. Besides, with the majority of the protestors remaining peaceful, there’s only been a select number acting with violent intent – who according to Bernie LaForest, member of the Tenther Community, stated was “mostly from the anarchist crowd from the G8 summits.”

This illustrates that with very little provocation (and in some cases none at all), our Government no longer seems interested in protecting our constitutional rights, but willing to reduce us to a “commodity” status where individual freedom has been reduced to a foot-note in the Fed’s 20 volume set of Red-Tape laws. Until Men Are All Like Angels, We’ll Need the 10th Amendment

Here’s a great article from last week’s Houston Chronicle, reminding us all why we need a government in the first place.  Men, no matter how noble today, can be corrupted in the snake pit known as Washington DC.  We can even look to FDR himself in this respect.  While governor of New York, Roosevelt touted the importance of states’ rights- then as president went on to lead one of the greatest challenges to state sovereignty in American history.  The founders trusted We the People, outside of the political class and the temptations of power, to be the ultimate check on tyranny.

10th Amendment needed because men aren’t angels

This past year, the federal government has marched further and faster than ever toward control of the economy and our everyday lives. This would dismay our Founding Fathers, whose vision of a carefully limited federal government animated the Constitution.

The most explicit statement of limited government in the U.S. Constitution is the 10th Amendment: “The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.” Thus, any power that the Constitution does not affirmatively give the federal government, it does not have.

The 10th Amendment embodied a revolutionary concept. Written just a few years after we had won our independence from Britain, the Constitution fundamentally changed the relationship between people and government.

For millennia, the source of power and authority had always been kings and government, and rights were seen as gifts by grace from the monarch. The Constitution inverted that understanding, with sovereignty beginning in the American people — beginning with We the People — and power given to government only to a limited degree.

Heading for a Cliff

Catastrophe is dead ahead, and it is clear to see – so why are we not stepping on the brakes? I think the November election will be a small “pump” of the brake but will that be enough? Our kid’s future is being spent on bailing out unionized, entitled Greek workers, who need to cut their own benefits, fix their own self made problems, and leave our kids money alone!

The federal government has a plan to end obesity, but the problem is it ends our kid’s freedom. These people are evil dictators disguised as do-gooders. We need to read the constitution and apply it; now!

Government healthcare will ruin healthcare. Unions are destroying the jobs they supposedly treasure. The government programs are destroying charitable giving. The education system is destroying education, respect for the flag and faith in God.

Unemployment “benefits” are destroying incentive to work. Illegal people in this country are taking jobs, undermining wages, bankrupting our community services, and filling our prisons. But we can’t afford a fence.

The free market is under attack and companies that make bad business decisions are being rewarded with political favor, and our hard earned income, and kid’s futures are being siphoned to takeover these failures. Utilities are raising rates to pay for the people that can’t pay but they somehow can afford other luxuries in life.

A minority leftist group has been staging this coup d’état for many years, and they are now implementing an agenda that hates, despises, and wants to destroy the constitution and America. They are in the driver’s seat speeding toward the cliff. We need a new driver. We need to start standing up for our principles.

We need to be proud that we pray, work hard and make money to support OUR families. We need to be proud that we volunteer and give to the charities WE believe deserve our support. We need to be proud of home schooling and private education, and promote education that supports OUR Kid’s future. We need to fly the flag, wear the flag, and sing our national anthem with a new vigor. We need to be proud Americans again believing in OUR INDIVIDUAL greatness that allows us to share our individual wealth to help others. We need to end poverty in Detroit and other communities of color by getting the people currently locked into generational government programs off of government programs and focused on the true American Dream. We need to drive back to our founding principles and constitution that has given us the greatness WE have created and stop telling lies that government has given us anything of worth. The last thing this government has given us of worth was the constitution.

Everything else has been driving us straight toward a cliff…

If you have been paying attention you know we are losing our country. If you have read our constitution you know it is being trampled as if it doesn’t exist. If you have been paying attention you are getting ever more anxious about how this is going to end up. If you have been paying attention you are feeling helpless to stop this madness. If you have been paying attention you are frightened. If you are paying attention you must get involved. If you are paying attention you need to learn our history and read our constitution. If you are paying attention you know you have to get everyone else’s attention…
