		<description><![CDATA[First, it takes a criminal charge against someone under the statute before there is any judicial review into the validity of the statute.   What you can generally expect is that the prosecution will likely have a case against a real loser who made all sorts of threats to kill someone and their grandmother, etc.    
 
This real loser, whoever it will be, will justify in the minds of some that &quot;we need laws like this to go after scum like this loser.&quot;   Others will make the slipper slope argument.  And then, the debate begins.

		<description><![CDATA[You&#039;re thinking like a lawyer.   Good article!   It&#039;s that same type of analysis that you can put to the U.S. Constitution and many other written laws to find out just how sloppy the human mind is.  When you look at the plethora of examples out there like this, it can really be discouraging to think how almost impossible it would be to have a consistent system that actually works.
