The Feds have acted with impunity for too long. Recently, American citizens have had their liberties stripped by federal laws that allow for the spying on phone calls, emails and text messages ; indefinite detention; and forcing you to buy health insurance.

Missouri Senator Emery has introduced SB 119, a bill to create a State Sovereignty Commission. This bill has been first read on January 9th of this year. This Commission will uphold the 10th Amendment. The 10th Amendment limits the federal government to only enumerated powers clearly defined by the Constitution. “The Powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people.”

“This act creates the State Sovereignty Commission. The role of the commission shall be to identify federal legislation that infringes on Missouri’s sovereignty, make recommendations to the General Assembly regarding state legislation that would preserve the principles of the Tenth Amendment of the United States Constitution, conduct inquiries with Missouri Congressional members regarding votes cast on federal legislation which may affect Missouri’s sovereignty, and refer cases to the Attorney General when the federal government requires the state or a state officer to enact or enforce provisions of federal law outside Congress’ enumerated powers.”

This commission will “identify proposed federal legislation that infringes on Missouri’s state sovereignty under the Tenth Amendment to the United States Constitution.”

The Oath of Office for all members of Congress states, “I do solemnly swear that I will support and defend the Constitution of the United States against all enemies, foreign and domestic.” The oath is to the Constitution, not to anyone’s agenda and not to any person. Lately Missouri has been fighting the over-reach of the federal government by introducing laws like HB 46 to nullify drones, HB 57 to nullify the NDAA. Also, Missour has said no to any Health Care exchanges.

The Constitution is a legal document. To be an enemy of the Constitution is to be an enemy of the Rule of Law and inalienable rights. Judge Napolitano defines a right in a Lew Rockwell blog post as, “So, our right to life, our right to develop our personalities, our right to think as we wish, to say what we think, to publish what we say, our right to worship or not worship, our right to travel, to defend ourselves, to use our own property as we see fit, our right to due process — fairness — from the government, and our right to be left alone, are all rights that stem from our humanity. These are natural rights that we are born with. The government doesn’t give them to us and the government doesn’t pay for them and the government can’t take them away, unless a jury finds that we have violated someone else’s rights.”

Missouri has seen that there is a domestic enemy. The Federal Government has decided that American Citizens do not have a right to due process, trial by a jury, a requirement of a warrant to conduct a search or seize of personal property, or even what to buy like health insurance. The way to fight unlawful laws is to say no! With this law, Missouri is committed to be duty bound to disobey all unlawful laws.
