@Mike Maharrey @dmellon I think it is a VERY important point that the people are the final arbiters and that they have delegated this power to the state governments because if the state legislatures fail to act, the people still retain that option. Perhaps the words "or to the people" will prove to be the key to restoring our constitutionally protected rights if legislators are cowered by the prospect of Supreme Court rebuke. Under that condition, how the people can act will be an issue but I think there is a mechanism that can be used that might even be beyond Supreme Court review.

OK however you have rights to your life. Also a constitution is a contract so when born your not under the contract of your parents. This is the difference between natural law compared to admiral law. Also the seperation of liberty to tyranny. Restricts the government to contractual law to pay debts, and protect its population. In return the people are to live honestly to hurt no one and give everyone his due.

I read another paper on the people being the final say for each state. Having said that I believe what is being said is about the state upholding our rights from the federal criminals so a civil war does not need to be started. So if you didn't like your states standing you could move and there by reduce the power of the state and federal governments. A example of this would be going to court as a jurist ona case of a bank robber. Lets say he took the money and no other "crime" was committed even though he was charged with others. How could you call him guilty when more money was stolen from everyone from the banks? Seems like he just made a withdraw. Inflation is just another way to tax everyone. The last one holding the money was paid the least. The first one to get the money (banks, insuance, other corperations on the lamb) have the highest rate of return. So you are taxed at a higher rate on your income tax than you think.

I could not be more of a supporter of nullification by any means, but there is one aspect of your description that troubles me. We know from the Constitution itself that it was the people of each state and not state legislatures that formed the compact that established the Federal Government. The people of each state therefore are the final arbiters of the constitutionality of federal laws. But we are asking state legislatures to make that decision. Is it your position that the people are acting through the state legislatures and have therefore delegated this power to the legislatures? Perhaps your position is there is no difference between the people and the legislatures. That is my problem, is it the people, the legislature, or both, or either that have this power?
