Health Care Freedom of Choice Constitutional Amendment – It is Time Georgia

The Citizens of the State of Georgia need to make their voices heard in this moment of history.

Washington D.C. has felt it appropriate to make its influence known in every county across these States United. It behooves The People to stand up in defense of the rights and liberties which were secured to us in the Constitution of the United States. In the name of general welfare and safety, the federal legislation machine manufactures and spits out unconstitutional laws in order to control us in the realms of  healthcare, gun ownership, education and property rights to name just a few.

Judge Andrew Napolitano stated a truth for the people to stand on in a commentary concerning President’s Day:

All presidents but Jefferson have argued that their first job was to keep us safe. All presidents but Jefferson were wrong. If you read the Constitution, you will see that the President’s first job – as Jefferson understood well – is to keep us free.

And The People are standing… The calls for nullification of  many over-reaching unconstitutional federal laws can be heard throughout the country and are now daily news. The nullification naysayers, as well, continue their dribble at the risk of their own liberty and freedom.

Name Calling and “Tenther Nullification Nonsense” in Arizona

AzBlueMeanie claims in the article Neoconfederate insurrectionists in Arizona Legislature revive discredited ‘nullification’ theory that:

All elected officials in Arizona take the following oath of office:

“I do solemnly swear that I will support the Constitution of the United States and the Constitution and laws of the State of Arizona, that I will bear true faith and allegiance to the same and defend them against all enemies, foreign and domestic, and that I will faithfully and impartially discharge the duties of the office of __________ according to the best of my ability, so help me God.”

And yet the Arizona legislature is populated by Neoconfederate insurrectionists who have violated their oath of office and are actively engaged in acts of domestic insurrection against the United States government.

Let’s get this straight now… AzBluemeanie believes that a state elected official who stands up against what he or she perceives to be a clear violation of the U.S. Constitution has “violated their oath of office and are actively engaged in acts of domestic insurrection against the United States government”. That is a pretty bold statement to make with no evidence to back it up. Nice job!

Let us bring some credentials into the discussion.

To the Affordable Care Act – we say Nullify It!

“Whensoever the general government assumes undelegated powers…..a nullification of the act is the rightful remedy.” That’s Thomas Jefferson’s message for unconstitutional acts like the Affordable Care Act, AKA Obamacare. James Madison told us that the states are “duty bound to interpose…to arrest the progress of evil….”

Today, we see undelegated powers – and the progression of evil. In response, our state needs to stand up and say NO. Please introduce, consider, and pass the “Federal Health Care Nullification Act” – as included in this petition. This bill will make clear that the state considers Obamacare to be unconstitutional – and will take all measures necessary to prevent its enforcement.

SCOTUS and the EPA vs Private Property

On March 21, TAC reported that the Supreme Court had ruled in favor of an Idaho couple who had been petitioning the court system to be allowed to make their case concerning EPA administrative heavy handedness. The post, U.S. Supreme Court: Idaho Couple can take EPA to Court, reported that the couple had been directed by the Environmental Protection Agency to restore their newly acquired home construction plot back to its original state or face stiff fines. The EPA would not allow an appeal, or even a hearing.

Article 1 Section 8 of the U.S. Constitution enumerates the main powers delegated to the federal government, specifically those of the Legislative Branch. An original understanding makes it clear that the Constitution does not authorize Congress to form a federal agency which can dictate what people can do with their private property. Just as it has no authority to demand the American people purchase something, Washington D.C. has no power to tell us what to do with personal or real property we own.

Utah, Colorado, Nevada and many other western states are neighbored by separate “federal states” which cannot be utilized for their own taxing purposes or to access the natural resources that reside within them. This is due to the fact that the federal government had either grabbed up the land when the state first entered the union, or had purchased it by some means. Regardless of how it was acquired, the federal land is within the state, and the people of that state cannot utilize it, in most cases.

Federal ownership of the land creates no benefit to the state itself. As U.S. Government Property, it is considered a resource of the U.S. Federal Government. In some instances, such as the Smoky Mountains in North Carolina, the area has been deemed A UNESCO World Heritage Site and is “legally protected pursuant to the Law of War, under the Geneva Convention, its Articles, Protocols and Customs, together with other treaties including the Hague Convention for the Protection of Cultural Property in the Event of Armed Conflict and international law”. Our Congress had to ratify that UN treaty. “While each World Heritage Site remains part of the legal territory of the state wherein the site is located, UNESCO considers it in the interest of the international community to preserve each site”.

How is that for giving away Sovereignty?

ACTION ALERT: Help Maryland Nullify the TSA

Un-consented contact means a contact that a person does not want, or contact that was informed as wanted to avoid. This is exactly what Maryland’s House Bill 1111 is proposing to make a crime. The legislation could substantially curb the federally mandated Transportation Security Administration’s (TSA) blatant violations of American’s civil rights. We urge you to contact the individual leaders of the House Judiciary Committee and express your support for this bill, and the protection of our Constitutional rights.

The Maryland State Legislature proposes in the bill titled “Public Safety – Restrictions on Searches for Security Purposes – Penalties”, to define illegal detention,  search, and seizure by a public servant as a crime against the victim of the encroachment, and authorizes the State Attorney General to make use of existing laws and the Tenth Amendment as a defense against any federally levied claims against its constitutionality:

Synopsis:

Prohibiting a specified public servant, while acting under color of the public servant’s office or employment, from intentionally subjecting another person to mistreatment or to arrest, detention, search, seizure, dispossession, assessment, or lien that the public servant knows is unlawful, intentionally denying or impeding another person in the exercise or enjoyment of a right, privilege, power, or immunity, knowing that the conduct of the public servant is unlawful, or intentionally subjecting another person to sexual harassment; etc.

Will Pennsylvania Nullify Health Mandates?

After having been reviewed multiple times since January 31st 2011, the Pennsylvania Senate passed Senate Bill 10 (SB10) by a vote of  29-19.  The bill is a joint resolution proposing an amendment to the Constitution of Pennsylvania which would prohibit any government from requiring the Pennsylvanians to buy health insurance. It states, in part –

“no law shall be enacted requiring a person to obtain or maintain health insurance coverage”

Pennsylvania Senate District 25′s Joseph B. Scarnati is the prime sponsor of the bill which still requires a vote by the General Assembly’s House of Representatives. Once fully passed by both houses, it can be placed on the ballot for a statewide referendum.

Already, ten states have passed similar bills, commonly referred to as the Health Care Freedom Act. With the current SCOTUS review of Obamacare, this action along with many others currently in process in other states, sends a clear message that Americans are not content with the Federal Government encroaching on their liberties.

The amendment, if approved by the people of Pennsylvania, would also prevent the federal government from imposing fines or penalties against people who don’t buy insurance — up to 2.5 percent of household income.

To Some, the Tenth and Nullification is Taboo

With a quip typical of a main stream media talking head, Scott Keyes traversed some well worn turf in the article entitled “Strict Constitutionalist’ Ron Paul Endorses Nullification As A ‘Very Good’ Idea”. In the post, Keyes attempts to justify federal legislative oversteps by referring to any act of congress as “the supreme law of the land” and thus, are good to go.  He makes no distinction in this assertion for the sovereigns of the state, or the individual.

It’s sad really…

As the Constitution lays out the framework for our great republic, the first ten amendments guarantee that the government cannot encroach on, or take away our freedom and liberty.

Our natural rights.

You might recall those. We have been losing a lot of them lately.

He comes to this conclusion by referring to the test of the Constitution which “states clearly that acts of Congress “shall be the supreme law of the land…anything in the Constitution or laws of any State to the contrary notwithstanding”

Keyes interpretation of the constitutional passage show no regard for the Ninth or Tenth Amendments.

Food Freedom for New Hampshire?

The mood of  New Hampshire’s  legislature concerning an overstepping federal government is clearly illustrated in NH HB1650. In no uncertain terms, the representatives of the people of New Hampshire have made clear their thoughts on the role of the United States Government,  declaring that Uncle Sam is bounded by the U.S. Constitution, and that when it decides to step outside these limits, it is unlawful  and of no effect. The bill has provisions which would make it a criminal act for its violation:

439-A:5 Penalty.

I. Any public servant of the state of New Hampshire as defined by RSA 640:2 that enforces or attempts to enforce a federal act, order, law, statute, rule, or regulation upon a foodstuff labeled “Made in New Hampshire,” that is produced commercially or privately in New Hampshire, and that remains within the state of New Hampshire shall be guilty of a class B misdemeanor.

Missouri Stands on Tenth Amendment to just say NO to Obamacare – HB1534

The Missouri State House has introduced proposed legislation, sponsored by Representative Kurt Bahr, and co-sponsored by Andrew Koenig, which would allow for misdemeanor charges being filed against any state or federal official attempting to enforce or implement the federal Patient Protection and Affordable Care Act in the state. The legislation also makes plain Missouri’s view, summarizing that the act is considered unconstitutional as it exceeds “the powers granted to Congress under the United States Constitution. Therefore, it is not law and is altogether void and of no force.” The tone of the proposed legislation clearly shows Missouri is not at all happy with the mandate sent down from D.C.

“Null and void from inception” is an accurate way of describing an unconstitutional law inferring it has  no basis or authority within the Constitution for the United States allowing it to be even proposed for debate or voted upon by Congress. The summary text is stating this idea clearly by relaying  ” it is not law and is altogether void and of no force”

Georgia Seeks Alternative to No Child Left Behind

Georgia is one of the first states to seek an alternative to “No Child Left Behind”, according to this article from the Georgia Department of Education’s website. Remove the burden of the Federal Government’s inefficient, non-attainable goals outlined in NCLB, and the states can move to create a program that can improve the quality of education for all students:

“Through Georgia’s College and Career Ready Performance Index, we will be able to use multiple indicators to determine a school’s overall impact on our students”, said Superintendent Barge. “This approach will do more to ensure that the K-12 experience provides students with the academic preparation to compete globally, as well as the career development skills aligned with the evolving requirements of our workforce.”
