When it comes to determining the powers constitutionally delegated to the federal government, most people get the process completely backward.
They assume the government has virtually unlimited power and authority, and then they try to shoehorn powers into the words of the Constitution. In his first systematic commentary on the Constitution, St. George Tucker gives the proper approach — start with the assumption the federal power doesn’t exist.
