Imagine if you and I had a contract but I constantly violated the terms. If you never did anything to enforce the contract, would that be the contract’s fault?
Of course not.
That’s the same problem we have with the federal government It’s not the Constitution’s fault. It’s our fault for not enforcing the terms.
