‘Resisting’ Is Defined as Violence. Not the ‘Taking’
Newsweek has put together a “Tax Attacks” propaganda piece. The gist of this piece is that Joseph Stack was one of many violent protesters who “believed taxes are unjustified,” and thus reacted with violent actions. Of course, anyone who believes that taxes are unjustified necessarily gets lumped in with all of the mad bombers, shooters, [...]
Tenther Homework
Professor Krey has an assignment for you tenthers out there. Please check out this video from the Federalist Society regarding “trying suspected terrorists in federal court” and summarize their arguments for me. The Federalist Society, much like the rest of the Beltway Right, is far too cozy with unconstitutional, warmongering neocons for me to ever [...]
Public Education and the 10th Amendment
A local (really good) blog, Holly on the Hill, ran a piece two days ago about Utah’s 10th Amendment rights. Among the replies were some progressive thinkers not entirely enthusiastic about the efforts under way to restore Utah sovereignty (shock). One, who goes by initials JBT, asked the following; I am asking the conservative readers of this [...]
Tenthers from the Left?
Yup, that’s right – they come from the left too. Ashby Jones reports on the Tenther movement from the liberal perspective at the Wall Street Journal: We’ve written a bit in recent months about the so-called “Tenther” movement. It’s a push by many, mostly on the right side of the political spectrum, to invoke the [...]
Wallbuilders Selective Originalism
David Barton of the organization Wallbuilders takes a firm stance against nullification. How could this be? Does he not profess to believe in the original intent of the U.S. Constitution? I guess that depends on whose intent. Barton, much like others, prefers to focus on the intent of a small faction which favored a super-powerful centralized [...]
The Year of State Sovereignty?
At a press conference last October Speaker of the House Nancy Pelosi was asked: “Madam Speaker, where specifically does the Constitution grant Congress the authority to enact an individual health insurance mandate?” She replied with that wild-eyed self-assurance that drew more shrill and extreme as we got to Christmas: “Are you serious? Are you serious?” [...]

NCLB – Federal Overreach in Education
Americans for Limited Government writes about No Child Left Behind. Another example of the states being bribed, with our money, to ignore the Constitution. Another opportunity for a strongly enforced Tenth Amendment to make a difference. By Chris Slavens The No Child Left Behind Act (NCLB), signed into law by Bush in 2002, relied on [...]
Are Same Sex Marriage Advocates Actually Tenthers?
They are if they oppose the federal Defense of Marriage Act on constitutional grounds. Which, as it turns out, is exactly what supporters of same sex marriage are doing in Massachusetts. From the Wall Street Journal: Last week, Massachusetts Attorney General Martha Coakley moved for summary judgment in a lawsuit, filed last July, brought by [...]
Madison’s Flip-Flop
A reader of my Nullification in a Nutshell took issue with my use of Madison as a proponent of state nullification due to the fact that he later wrote against it. Here is what I wrote in response: I was aware that Madison later changed his tune on nullification, Mr. Ressa, as your quotes from [...]
Maryland Sovereignty Resolution
On December 19, 2009 we challenged MD legislators on The Forgotten Men radio show (on 930 WFMD) to introduce 10th Amendment legislation. One sitting MD state Senator called in and committed to it.
Maryland now joins the growing number of States that have introduced non-partisan State Sovereignty resolutions. While a resolution doesn’t carry the force law, it nevertheless delivers a message; A message that firmly supports what the framers intended.
Strategy Discussion
I wrote the following for THE NEW AMERICAN: This is the first FFA in the nation where federal officials could be criminally prosecuted for trying to enforce federal firearms laws. While that might sound good to some, the states need to be cautious about appearing as the aggressor. One false move could tarnish the state [...]
Utah Legislators Call for Fiscal Federalism
Tea partiers take note: at the forefront of any effort to reduce the size of the federal government should be the devolvement of federal programs to the states. Achieving this may seem like mission impossible given the states’ addiction to federal money. However, there are signs that the idea of returning the relationship between the [...]
Virginia Firearms Freedom Act to Be Heard By Senate Committee this Week
Got an email blast over the weekend from Campaign for Liberty’s Donna Holt about the status of HB69 (Virginia Firearms Freedom Act). Looks like Delegate Carrico’s HB69 has been assigned to the Senate Courts of Justice Committee. The Senate Courts of Justice Committee meets on Mondays and Wednesdays. The bill is not on the docket [...]
The Overton Window: Two Concepts for Activists
Introduction In this essay, we will look at two ideas which effect nullification and Tenth Amendment efforts in America today. One of these ideas, the idea of incentives, is familiar to all of us. Another idea, the Overton window, may be less familiar. Incentives People are influenced by incentives. As Dr. Perry often writes at the [...]
Centralizers vs Tenthers on the Economy
“If only D.C. were more like Bejing!” In an article that could have easily been entitled “Abolish the States,” Harold Meyerson of The American Prospect, laments the ways the states have prevented the bureaucrats in D.C. from centralizing even more power. Why? Because the states aren’t draining wealth from their citizens fast enough as the [...]
Scott Brown’s Scorecard: 0 for 1.
Off to an unconstitutional start. Not surprising, but I wonder how commonplace this is going to be for the new “maverick” in the Senate. A modest job-creation bill advanced in the U.S. Senate on Monday as the chamber’s newest Republican bucked his party and sided with Democrats on a $15 billion package of tax cuts [...]
10th Amendment 101
While we could easily add more, this list is pretty much the ultimate guide for you – read them at your convenience and leave questions in the form of a comment, so we can discuss.
States Rights, Yes, But That’s Not All
As Jefferson said, the American principle supports the states as versus the central government, the counties as versus the states, the towns as versus the counties, the wards as versus the towns, and the individual as versus all. Radical decentralism is the libertarian principle. Originally posted on the LewRockwell.com blog
Out of Control and Back Again
The prospect for a better future can never be realized if we continue to set our eyes on a central “authority” to fix this mess. This current economic and political mess was created because we took our collective “eye” off of the US Constitution and turned the focus on politicians in Washington DC. Since FDR [...]
Never Forget
One thing that was edited out of my latest cover article from The New American due to space constraints is something we should never forget when it comes to the issue of “federal funding.” Whenever you hear a centralist, whether from the left or the right, telling you that the federal government should cut off [...]
The Alternative to Universal Voter Registration
In his recent talk at the David Horowitz Freedom Center, The Wall Street Journal‘s John Fund performed a public service in warning America of Democrats’ plans for universal voter registration, or UVR. It may sound like a just and decent thing to advocate, but UVR is nothing less than a means for Democrats to pack the electorate [...]
Ron Paul Speech At CPAC
