Montana Voters Nullify Obamacare Mandates

Tonight another state puts a firm boot on the neck of Washington D.C.

The “Montana Health Care Freedom Act” otherwise known as Referendum 122, prohibits the state and federal governments from requiring the purchase of health insurance or imposing any penalty, tax, fee or fine on those who do not purchase health insurance.

The prohibition does have some restrictions, but the good thing about this…these rules are being set by the state of Montana, not the the Federal Government .

Referendum 122  Passed 66% YES to 34% NO

This makes Montana the 3rd state to nullify Obamacare after the SCOTUS decision that called it “constitutional” this summer.

The interesting thing about Montana’s nullification measure is the wording…

THE LAW READS

The state or federal government MAY NOT:
(a) mandate or require a person or entity to purchase health insurance coverage as
defined in 33-22-140; or
(b) impose a penalty, tax, fee, or fine of any type if a person or entity declines to
purchase health insurance coverage.

This Law is effective January 1, 2013.  Exactly one year prior to the proposed implementation of Obamacare.

The People of Montana have spoken loud and clear, and the message is…

We don’t need no stinkin’ permission to exercise our rights!

 My curious mind wonders is Montana gonna reimburse the taxpayers what the federal government imposes?? How is a state gonna nullify a federal mandate to benefit the taxpayer? I like the idea. Some research I need to look into.

Great job people I live in Massachusetts / taxahusetts people in this state believe anything the crooks in our State House & these yuppies have NO BALLS!!! Does this mean that the people of Montana intend to stop paying Federal Taxes? The $50 billion a year in unpaid medical expenses for the uninsured is also a "penalty, tax, fee, or fine if a person or entity declines to purchase health insurance coverage", without ObamaRomneyButlerHatchcare, this will continue to be paid from our tax dollars.Ya big dummies.

 @jcitarello "Does this mean that the people of Montana intend to stop paying Federal Taxes?"  That's a stretch.  I see Montana not liking ObamaCare.  Each State, at least MI and MN do, already has a safety net for health care.  What Obama wants to do is broaden that safety net.  The 50B is an issue.  Maybe that's also something Obama is trying to get a handle on.  We need Health Care reform, but is ObamaCare the answer?  To me, that's the bigger question.

 @WayneNeva   If you feel you need a health care "safety net" move to a state that has one, like MA.  It should be left to the states, it's not within the president's authority to do this.  This is the fact of the matter.  The states are duty bound to resist unconstitutional acts of the federal govt.

 @JohnMichaels  @WayneNeva You are absolutely correct john. Every state is different (geographically and culturally) and has its own personal needs to suit its people best. The best way to meet these needs are the local people them selves, not a hand full 1000 miles away trying to make every state the same. Our country was meant to be State ran for this reason, not Fed ran.

 @JohnMichaels Sure I do.  I listened to the debates, ANYTHING (such as the number of food stamp recipients going from 23M to 47M, unemployment rate staying high, massive bailouts, etc, etc).  Obama didn't look surprised.  Almost as if he was saying "so what's your point?"  He's ruining America.  What a numskull.

 @WayneNeva So you do understand this is the plan of the federal government...to make us dependent on them for virtually everything.  If we don't stand up and say no, the power structure will leave the hands of the people where it originates, and the federal government will take it.  This is how a tyranny works.

 @JohnMichaels I don't feel I need a safety net, my point is that the States already have things in place (in MI we have "MiCare", in MN they have there own version, in MA they have something.  But it's all at the state level) so why is the Gov wanting to federalize this?  (and that's a rhetorical question).

 @jcitarello I was going to write a very eloquent response to you, but it's my birthday and I am just going to call it like it is.  You were raised on TV and fluoride in your drinking water, you probably ate some paint chips too,maybe in the government school you went to.  Why don't you tell me the Civil War was about slavery next.  Stop looking for someone else, like the federal government,  to solve all your problems.  Fess up and be a real person and stop putting your fears and problems on me.  Plain and simple the federal government is not authorized to mandate health care in the constitution... Me and you and everyone who makes up this country give the federal government ALL of it's authority and when it breaks the rules and tells me or you or any of it's masters what to do outside of the very limited powers we have granted to it, we are not bound to obey them...you can go ahead and pay them whatever illegal tax that you want, but almost half the states are now refusing...it's no skin off my back and I am sick of arguing with all of you who hate liberty and have never taken the time to read or understand the constitution.  Go and let the government be your daddy, I am through with you.  Oh and I mean that in the nicest possible way, you stooge.

All sounds so wonderful can stand up against the Federal Govt?   Keep hearing we do not want the govt. in our health care?   Try being 65 like me now and guess what I have to have Govt run health care?  I still am paying to keep myself covered also and no real choices?    Explain to me also when you lose your job and no longer have health care what to do?  I am an RN I know the many stories out there on when this happens?   Have a local woman in my Ga small mtn town about to lose her home per cancer and did not have enough coverage?   Is this the kind of country we want here in this pretty rich USA not care for those who fall on hard times?   Study what does it cost you and I the tax payer for the use of our ERs ?  Many immigrants here in Ga use our ERs along with those without health care?   We need to find a way to take care of the almost 50 million without health care?   Not saying Obama care was the best way but who cared until he tried to do something?   Think Vermont and Oregon care.

Not to mention the billions of taxpayer dollars wasted on unused prime real estate, land, buildings, vehicle assets, that list goes on and on. These are just a few examples of what needs to be fixed. Fix the real problems, put all that money back into the till and guess what, no need to raise taxes under false pretense, or otherwise. First and foremost, these criminals in this administration have to go!

 @MooseWarwick Moose, what about this situation.  You have a serious illness, have lost your job, and can't even afford your own health care.  You also can't afford the illegal income tax the federal government demands to help cover a national health care plan...well now you're going to prison where you'll have health care.  Who's paying for that service while you're in prison...well other people who are barely able to afford their own health care.  Where does it end?  The Federal Government can't even run the post office, and they handed our system of currency off to a private bank, mostly owned by foreign countries...what's going to happen when they realize they are over their head in this health care system...hand it off to Canadia?  Moose, the truth is, if the Federal Government would abide by the rules we gave it, we would all have enough money due to a thriving free market.  Jobs would be plentiful, and without the FDA (an unconstitutional organization) Dr. Stanislaw Burzynski would have his cancer cure available to all Americans, not just people in other countries and those who are granted a pardon on their disease by being accepted into a FDA clinical trial.  In case you haven't heard...there is a proven cure for cancer, but because of our Federal Government being in the pocket of big pharma, this cure will never be available because there is too much money in treating cancer with toxic chemicals that slowly strip your life away, just the the Federal Government is slowly taking away all our liberties.

I applaude the states for standing up against what is wrong on many levels. But isnt it true that federal laws supercede state laws therefore isnt this more or less symbolic?   Hopefully it will draw some more attention to it. And about the taxes originated in the  house of reps, if thats true then that needs to be pursued especially if the supreme court called it a tax. This president is over stepping his boundaries.

It doesn't matter what the government wants after it's been Nullified by a State. And the Federal Government has no Authority to Overstep its Authority or sik the IRS after people either. Since the power of the United States sits with each State Individually, the Federal Government has no power. Sure, Abraham Lincoln suspended the Constitution and sent the Northern Troops to take what the South told them they could not have, which started "The Time of Northern Aggression" or what Northerners call The Civil War, and then said it was about slavery, which it wasn't. And since that "Suspension" of the Constitution was never Lifted, we are still living in a country with no Active Constitution and living under British Admiralty Law. What that in mind, being that this is 100% accurate, the only way we can keep the Powers That Be from taking from us what we have earned, is to tell them to to Sh*T in their hats and be ready, willing and able to back up our words with our Liberty's Teeth, if and when that time comes. They never taught this in school and they hope that Americans never find this out. America is a Corporation, by Law. And As Such, the Property of the District of Columbia (that's you and me) must fight for their Rights to survive. Obamacare is only there to take away what is left of what we have earned. They think they own us. Well, the flock is sick and tired of being cattle. Time to awaken the sleepers and be ready for Civil War. I'm afraid it might just come to that, if push comes to shove.

 @JayAre1 Please back up your statements with verifiable references. vis a vis, America is a "corporation," living under Admiralty Law? Sounds a bit like nonsense to me, but if there's a RELIABLE source for these claims (read: not conspiracy or personal vanity sites), it would be interesting to hear the reasoned arguments.

The LAW states that ALL "taxes" have to "originate" in the House of Representatives.  Obamacare was declared a TAX by the U.S. Supreme Court.  Obamacare "originated" in the Senate---making Obamacare totally UNCONSTITUTIONAL!!!!

 @MichelleCook1  @CallieCarver Alabama is hurting financially and how many there are needing health care per loss of jobs?  Please look up the state of Ala. has no real choices on health care, per they are covered mainly by Blue Cross almost 80%?    Where are you to go?    So those without affordable health care good luck?

I certainly don't want the Federal Government, which is at the BOTTOM of the power structure in our form of government, trying to force me to pay for anyone else's problems.  Tell me why I should be responsible for an economy that the Federal Govt. ruined in the first place.  In this country, under the Constitution of the united States, where does it authorize this?  Just tell me where it says that I have to obey unconstitutional acts or mandates set by the Federal Government, a government which we created, a government which get's it's limited amount of power FROM WE THE PEOPLE.  Show me the statute, or amendment, or ANYTHING that makes this authority possible.  Just show it to me.

 I fully support this but do not see the practicality of it. The IRS will still impose fines and if you do not pay, they will issue liens. I am curious to see how this plays out.

 I totally agree with that. The nullification is a good first step. When all else fails, it may be time to water the tree of liberty. I was just stating that it is a symbolic victory and not a real victory.We need all the states to nullify it.

"Speech" not always being spoken or written, but sometimes acts, including civil disobedience, etc. I think? Might not stand up in court. Who wants to be the first to try?I'm exercising my free speech rights by not paying as "a statement." Do you think it would fly? Probably not, but, y'never know...

It is the States that are supposed to have control over the main measures of their people, and the federal government to assist where it crosses state lines. The entire Obamacare plan was done without state consent, and without the consent of the people. We are obligated as individuals (no matter what side of the politifence we stand on) to stand up for the rights we have, and demand accountability on all levels of government involvement in our lives.
