We expect 20 or more states to introduce Defend the Guard legislation during the 2021 legislative session. This is a state bill that prohibits the deployment of a state’s National Guard units into foreign combat zones without a declaration of war, as required by the Constitution.
This is a way states can push back and help restore constitutional war powers. But there are other practical reasons to support this legislation. These unconstitutional wars steal valuable resources from the states.
