Representative Carl Seel,ย has introducedย 3 separateย bills that work together to give theย citizens ofย Arizonaย a chance to voteย on prohibiting the implementation of the Affordable Healthcare Act in Arizona and the expansion of medicaid.

Each bill is a proposal for an amendment to the state constitution and would need to only pass the state House and Senate to go to the voters for approval. ย After Gov. Brewer worked to participate in Obamacare after speaking strongly against it, this path is a good strategy to avoid her likely veto.

First isย HCR2007, whichย wouldย change Arizona statutes byย amending Section 1.ย  Title 20 of theย Arizona Revised Statutes by adding chapter 23, to read the following:

This state may not establish or administer a stateโ€‘based health care exchange.

2.ย  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article IV, part 1, section 1, Constitution of Arizona.

Next isย HCR2008, which would amend title 36, chapter 29, article 1 of theย Arizona Revised Statutes, by adding section 36-2901.10; relating to the Arizona health care cost containment system. This bill simply states the following:

Any statutory or administrative expansion of eligible person, as defined in section 36-2901, does not take effect until the joint legislative budget committee certifies to the governor, the president of the senate and the speaker of the house of representatives that the expansion will be budget neutral for the next twenty fiscal years.

2.ย  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article IV, part 1, section 1, Constitution of Arizona.

Last, isย HCR2009, whichย would amend title 36, chapter 29, article 1 of theย Arizona Revised Statutes, by adding section 36-2901.10; also relating to the Arizona health care cost containment system. This bill deals with childless adults and reads as follows;

Notwithstanding any law to the contrary, the administration shall not use monies from any fund established pursuant to this chapter or from the state general fund to pay for services to childless adults.

2.ย  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article IV, part 1, section 1, Constitution of Arizona.

Carl Seel believes that the citizens of Arizona should decide if they want to participate in the unconstitutional ACA, or not. When I spoke with Representative Seel about his bills, he expressed his outrage for Obamacare and his urgency to remedy the unconstitutional act.
